Car Culture, Inc. ("CAR CULTURE") respects the privacy rights of its customers and visitors to the CAR CULTURE website located at www.carculture.com (the "Site"). We have prepared this "Privacy Policy" so that you will know how and when we collect information that can specifically identify you ("Personal Information"), and how we use this information. CAR CULTURE collects Personal Information from its customers and Site users and others through the means discussed in this Privacy Policy. By participating in the activities described below and/or using the Site, you acknowledge that you have accepted the terms set forth in this Privacy Policy and the Terms and Conditions.

What is Personal Information?

Personal Information includes basic contact information (such as your name, e-mail address, postal address, telephone number), as well as other information necessary and related to completing a transaction or providing you with services as may be requested by you (such as credit card information to process your purchase request).

How does CAR CULTURE Collect Personal Information?

Off Site Transactions

CAR CULTURE collects Personal Information directly from you in connection with your requests to CAR CULTURE for information and materials by means of email, telephone, facsimile and postal mail, as well as through the Site.

Personal Information Collected Through the Site

CAR CULTURE collects Personal Information through the Site in two ways: automatic collection and direct collection.

Automatic collection: Like all web servers, the web server(s) of the Site automatically creates information files regarding basic use of the Site. These statistics logs do NOT record a visitor's name, address, phone number, credit card numbers, or any other personally-identifying information. Rather, the logs contain the Internet Protocol Address (IP Address) of each machine that accesses the Site and indicate basic Site use information, such as pages navigated and the duration of each page view.

The Site also uses "cookies". Cookies are bits of electronic information that a website can transfer to a visitor's hard drive to help keep records of the visitor's use of a site. Cookies allow website operators such as CAR CULTURE to help customize the Site to the visitor's individual preferences and to retain the visitor's log-in information if the visitor registers with the Site. The use of cookies is standard on the Internet, and many major websites use them. Although most web browsers automatically accept cookies, generally you can change your browser either to prevent this or to notify you whenever you are sent a cookie. If you choose to not accept the CAR CULTURE cookies, you may not be able to access certain portions of the Site.

Direct collection: When you register with the Site, CAR CULTURE will ask you for your name, email address, postal address, company affiliation and company URL, telephone number and facsimile number, country location, and some information about yourself, such as the industry in which you work and your job description. We also collect the names, email addresses and other related information that you input in connection with sharing files by means of our lightbox feature. When you obtain a license for which there is a required payment, you will also be asked for payment information, which will then be processed by CAR CULTURE or its authorized service providers.

How Does CAR CULTURE Use Personal Information?

General Uses

CAR CULTURE may use your Personal Information in the following ways: (i) to respond to your requests for information; (ii) to process your requests for licenses and implement our Site features; (iii) to provide you with communications, newsletters, emails and other information; (iv) to send marketing and promotional communications from CAR CULTURE and/or its business associates; (v) for purposes included in this Privacy Policy; and (vi) for any other use specified at the time the Personal Information is collected or prior to CAR CULTURE's use of the Personal Information for a new purpose.

If you would like to "opt-out" of CAR CULTURE's use of your Personal Information, please follow the directions in the Section entitled "How Do I Update My Personal Information and Privacy Preferences?" However, by "opting-out", you may not be able to use the foregoing services and you may prohibit CAR CULTURE from responding to or processing your request for information, products or services.

Creation and Use of Aggregated Information

We may use your Personal Information and other information about or provided by you to create "Aggregated Information". Aggregated Information is created by aggregating or generating statistical data from Personal Information about groups of customers and Site users. Aggregated Information is also anonymous data, because it cannot be used to identify a particular individual. We may use Aggregated Information for marketing purposes, including sharing Aggregated Information with our business associates, to better understand visitors to the Site and our customers, and to improve CAR CULTURE services.

May My Personal Information Be Disclosed to Others?

CAR CULTURE takes reasonable steps to restrict disclosure to the Personal Information that we collect from customers and our Site visitors, but may provide access to such information as follows: (i) to parties authorized by CAR CULTURE to host, operate and maintain the Site and to provide CAR CULTURE services in accordance with this Privacy Policy, the Terms and Conditions [HYPERTEXT LINK] and any other applicable agreement between you and CAR CULTURE, or with your prior consent; (ii) to provide you with customer service; (iii) to protect the rights, property and safety of CAR CULTURE, its affiliates, business associates, customers and Site visitors or others; (iv) to parties engaged by CAR CULTURE to process information to fulfill purposes authorized by you (such as the processing of your credit card payment for a product, or shipping to you an ordered product); or (v) to relevant parties in the event of a bankruptcy, merger, acquisition, joint venture or other business transaction involving CAR CULTURE.

Further, CAR CULTURE may also disclose Personal Information if required to do so by law, or if CAR CULTURE believes that such action is necessary to: (a) comply with the law or with a legal process such as a court order, subpoena, search warrant or a law enforcement request, or (b) protect against misuse or unauthorized use of the CAR CULTURE Site or other CAR CULTURE content.

Is My Personal Information Secure?

CAR CULTURE uses reasonable precautions to keep Personal Information it receives secure. To reduce the risk of unauthorized access, maintain data accuracy, and help ensure correct usage of information, CAR CULTURE has put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information it collects online. Nonetheless, CAR CULTURE does not guarantee the security, accuracy or completeness of any such procedures. You should be aware that third parties might unlawfully intercept transmissions of Personal Information or misuse or abuse the Personal Information that is collected from you. Please remember that you play a valuable part in security as well. Your password to access the Site, which you select at registration, should never be shared with anyone and should be changed frequently. Each time you have used the Site, you should also log off the Site and exit your browser in such a way to ensure no unauthorized persons can use the Site with your name and account information. Regardless of the precautions taken by you and by CAR CULTURE, "perfect security" does not exist on the Internet. CAR CULTURE cannot ensure or warrant the security of any information you transmit to us, and you transmit such information at your own risk.

Can Minors Use the Site?

Many young people love cars, and CAR CULTURE encourages parents and guardians to spend time with their children while online visiting the Site. We require children over the age of 13 to obtain parental consent before submitting any information to the Site. Children under the age of 13 are not eligible to use the Site.

How Do I Update My Personal Information and Privacy Preferences?

If at any time you need to update or correct your Personal Information with CAR CULTURE, notify us of your preference to "opt-out" from having CAR CULTURE retain any of your Personal Information, change your preference as to receipt of information and materials or our sharing of your Personal Information with third parties, or if you just have a question, comment or concern about how CAR CULTURE uses your Personal Information, simply contact us in writing at the following addresses:
